Storing the safekeeping documents of a housing company under construction

A founding shareholder shall ensure during the construction stage that documents concerning the company, its financial plans and the construction and renovation project (safekeeping documents) shall be deposited in the Regional State Administrative Agency before the housing shares are offered for sale, if the housing company has not acquired a loan from a savings bank or a credit institution. The safekeeping documents shall be deposited in the Regional State Administrative Agency of the area where the company’s buildings are located.

The construction stage ends when the building inspection authority has accepted the building or buildings owned by the company for use in full and a new board has been elected for the housing company. Thereafter, the safekeeping documents shall be released to the board.

The safekeeping documents are not to be kept in a bank or a credit institution.

A fee is charged for the service.

The Regional State Administrative Agency charges a fee plus value-added tax for storing the safekeeping documents. The fee is based on commercial grounds in accordance with the Government Decree on fees. The fees are determined by the Government Decree on the Regional State Administrative Agencies’ Fees in 2019 and 2020.
