Deviation permit

For a special reason, it is possible to apply for a permission to deviate from the provisions, regulations, prohibitions, or other restriction that apply to construction work or other measures. A deviation permit is required for any construction work that is in violation of the valid zoning plan, as well as for all construction in shore areas not covered by a detailed plan.

To whom and on what terms

If the entrepreneur has established itself in another country in the European Economic Area and temporarily offers services in Finland, the same permits are required as from entrepreneurs established in Finland.

A deviation permit must be applied for with the authorities, and there must always be a justified reason for the deviation.

Before resolving a deviation matter, the municipality provides the neighbours and others whose housing, work, or other circumstances may be significantly affected by the project, with an opportunity to submit a written opinion. The municipality will inform the above-mentioned parties about the deviation application. The municipality may charge the applicant for the costs of informing the involved parties. Before resolving the deviation matter, the municipality can, if necessary, request a statement from the Centre for Economic Development, Transport and the Environment, some other public authority, or the regional council, if the deviation is significantly related to the scope of their activities.

A deviation permit will not be granted if it

  • has a negative impact on land use planning
  • has a negative impact on the realisation of the local detailed plan or other arrangements concerning the use of the areas
  • interferes with the achievement of nature conservation objectives
  • interferes with the achievement of objectives related to the protection of the built environment
  • leads to construction work with significant impacts; or
  • otherwise has significant adverse environmental or other effects.

Deadline

The deviation decision must be made before the building permit application can be processed.

Period of validity

The deviation decision will be in effect for the period stated in the decision, which is two (2) years at most. You must apply for a building permit within the specified period.

Background information

In certain situations, applying for a building permit may first require a planning requirement decision or a deviation decision.

The builder must have a valid planning requirement decision if they are applying for a building permit in an area requiring planning. The application for a planning requirement decision must be submitted to an authority designated by the municipality before applying for the building permit.

The municipality will determine whether the site in question is located in an area requiring planning. An area requiring planning is an area that is not covered by the municipality’s local detailed plan but where there may be a need to take measures such as constructing roads, water pipes or sewers.

The planning requirement decision will be in effect for the period stated in the decision (a maximum of two years). An application for the building permit must be submitted during this period.

If the builder wants to deviate from the local detailed plan or other provisions, regulations, prohibitions or restrictions that are in accordance with the Land Use and Building Act or that have been issued under it (such as the building code), they must obtain a deviation decision before being granted the building permit. The municipality may grant the deviation under certain conditions.

There must always be a particular reason for deviations. The deviation may not interfere with other uses of the area, for example, or cause damage to nature.

The deviation decision will be in effect for the period stated in the decision, which is two years at most.
