Compensation for a travel organiser’s bankruptcy or insolvency

A provider of travel service combinations is obliged to provide the Finnish Competition and Consumer Authority (FCCA) with a bankruptcy security if the company collects advance payments or offers transport services.

Passengers are entitled to claim compensation from the security if the company goes bankrupt or is declared insolvent.

Do the following

Apply for compensation using the Finnish Competition and Consumer Authority’s online form. If you cannot fill in the online form, you can order a paper form from the following email address: konkurssit@kkv.fi.

Submit the application within six months after the declaration of the company’s insolvency or bankruptcy.

  • Alternatively, if you have paid for your trip with a credit card or credit granted for purchasing the trip, you can request the refund from your credit provider. You can also request a refund for a debit card payment if your debit card company has committed to this in their terms and conditions or otherwise.
  • If you have purchased a travel package in cash or by transferring the money from your bank account, fill in the Finnish Competition and Consumer Authority’s compensation application.

To whom and on what terms

Compensation is only paid for purchased travel packages and combined travel arrangements or purchased gift cards that can be used to procure travel packages or combined travel services.

The security cannot be used to compensate for e.g.

  • day trips that last less than 24 hours and do not include overnight stays
  • financial losses caused by lost working hours
  • travel insurance
  • visas
  • vaccination costs
  • the distress caused by a ruined holiday
  • tour packages purchased at the destination
  • trips purchased under a general agreement for the arrangement of business travel
  • gift cards given free of charge for promotional purposes.

If the trip was purchased from a travel organiser who is not in the Travel Guarantee Register maintained by the FCCA, the purchaser of the trip will not receive compensation from the FCCA in the event of the organiser’s insolvency or bankruptcy.
