When does the continuing power of attorney end?

Continuing power of attorney may end if

  • the granter cancels the power of attorney
  • the granter dies
  • the attorney is no longer able or willing to perform the task

What must the attorney do when the continuing power of attorney ends?

The obligations of the attorney depend on the reasons why the power of attorney ends. The power of attorney may end because the granter dies. In that case, the attorney must hand over the granter’s property to the estate shareholders. 

The attorney must also prepare the final statement for the estate unless the attorney is explicitly relieved of this obligation in the power of attorney document.
