Comment service for agreements
- Public service
In civil matters concerning employment between an employer and employee, the Employment Fund will make a comment on the draft of a settlement agreement, upon request by the agreeing parties. The parties share the responsibility of agreeing upon how to reconcile the compensation for ending an employment contract unfoundedly and earnings-related unemployment benefit. By requesting for a comment on the agreement, the agreeing parties may verify what size the reduction to the Employment Fund should be after the reconciliation, before they sign the agreement.
There is no legal obligation to request the Employment Fund to comment on an agreement. In practice, however, the commenting procedure reduces the need to make alterations to signed contracts. Therefore, we recommend that you should always request for a comment when settling civil matters concerning the end of employment.
