Changing guardians or termination of guardianship

If you are dissatisfied with the actions of your guardian, you should first discuss the problem with your guardian. For example, if you feel that your allowance is not big enough, your guardian can determine whether the amount could be increased within the limits of your financial situation.

If your guardian is a public guardian, you can contact the Chief Public Guardian. The Chief Public Guardian is the supervisor of guardians. For example, if you feel that you have been treated inappropriately or suspect that your affairs have not been handled appropriately, the Chief Public Guardian may discuss the matter with your guardian.

If you feel that your guardian has acted against your interests, you can file a complaint with the Digital and Population Data Services Agency.  Opens in a new window.

If you want to change your guardian, you can apply for a change of guardian alone or together with your guardian. 

At this time, you can propose a certain person or a public guardian for the task. It is quite common that at some point the client’s family members want to transfer the guardian’s tasks to a younger person. If you propose a private person for the task, the consent given by the person in question must be submitted as an attachment.

Even if you do not propose a replacement, the Digital and Population Data Services Agency is responsible for finding a new guardian if you still need one.

Below are some of the situations in which the guardianship will be terminated:

• the client’s condition improves and no longer needs a guardian
• the task that the guardian was appointed for has been completed.
• the guardian has been appointed for a fixed period; in such cases, the guardianship ends automatically at the end of this period
• the client or the guardian dies.

If your situation changes and you no longer need a guardian, you and your guardian may jointly apply for the termination of the guardianship from the Digital and Population Data Services Agency. You will need to attach a medical statement on your state of health to your application.

If you and your guardian disagree on the need for guardianship, the Digital and Population Data Services Agency cannot terminate the guardianship. In such a situation, you can apply to the District Court for the termination of guardianship alone.
