Registration of real estate and letting agencies

Do the following

Before engaging in operation as an agency, submit a notification to the Regional State Administrative Agency in the area where the main part of the business is to be conducted in order to be entered in the register. You can submit the notification on a form or through web service. Please enclose the consent given by the responsible manager to be assigned and a copy of the liability insurance policy.

The Regional State Administrative Agency will find out the professional qualification and bankruptcy, business prohibition, guardianship, penalty and criminal records with regard to the responsible manager and obtain an extract from the trade register.

Notify the Regional State Administrative Agency without delay about changing of address, company name or liability insurance and of a new place of business. You must submit a notification about changing the responsible manager no later than one month after the assignment of the previous one has ended.

To whom and on what terms

The notifier must have the right to engage in a trade in Finland.

The agency must have a responsible manager who has the professional qualification proven by an examination for agents, which means an approved real estate agent with respect to a real estate agency and an approved real estate agent or approved letting agent with respect to a letting agency. The responsible manager has to be an adult and reliable person who has not been declared bankrupt and whose legal competence is not restricted.

The notifier must have a sufficient liability insurance to compensate any economic losses caused by the activities. The sufficiency of the amount insured by the liability insurance depends on the quality and scope of the agency’s activities. The sufficiency of the insurance will be considered on a case-by-case basis. The other conditions of the insurance must correspond to the usual insurance practice.

The Regional State Administrative Agencies have considered that the liability insurance of small real estate and commercial leasing agencies must be at least € 50,000 while the excess should be no more than € 1,000. Small residential leasing agencies must have a liability insurance coverage of at least € 20,000 while the excess should be no more than € 1,000. A sufficient liability insurance for large agencies has generally varied between € 100,000 and € 200,000 while the excess has been from € 2,000 to € 3,000 at the most.
