If a privately-owned property lies within a protection zone or a visibility zone of a road, the landowner should be aware of the limitations and obligations concerning building on those areas.
Also, when there is a plan to repair a building situated on a protection zone or a visibility zone, an opinion must be requested from the local ELY Centre before the licensing authority processes the matter regarding a building permit or an action permit.
Building on the direct vicinity of a road is restricted mainly for road safety reasons and on the other hand because a road has negative effects on habitability. On application, ELY Centre can for a specific reason give the applicant permission to build on a road protection zone if the construction works or the use of the building, construction or equipment do not pose hazards to the traffic safety or cause nuisance to the road maintenance.
A protection zone of a road extends, as a rule,
- on regional roads and connecting roads to 20m
- on highways and main roads to 30m
- on motor ways and motor-traffic ways to 50 m
distance from the centre line of a driveway or, if there are multiple driveways, from the centre line of the closest driveway.
The visibility zone of a road is the area without visibility restrictions required in curve points, intersections and level crossings of the roads. The purpose of a visibility zone is to safeguard road safety by preserving a good visibility in curves and crossings.
All adjoining owners must be consulted in connection with a pending building project. Before applying for a permit, you must send a request for the neighbour's opinion to the local ELY Centre. (The road keeper is an adjoining owner in the same way as other neighbours of the plot). Attach the statement you received to the permit application.

Use the e-service primarily.
Signing into the service requires strong authentication. You will need either a bank ID, a mobile certificate or a certificate card.
If you cannot use the e-service, you can use printable forms. Irrespective of the location, submit the application form to the registry of the Pirkanmaa ELY Centre (P.O. Box 297, 33101 Tampere).
Fill in the application form carefully.
Before applying for a permit, you must also obtain the following attachments:
- a copy of the road maintenance authority’s (local ELY Centre’s) consultation of the owner of the neighbouring property
- a certificate of the permission to build (an urban area development land, a planning decision or other evidence)
- site layout showing the location of the buildings/constructions on the site and their distance from the centre line of the road
- map indicating the location of the site in relation to the road
If you supplement the application later, email the supplementary information to email@example.com. Enter the application’s service ID number, file number (PIRELY/xx/20xx) or the name, municipality and road number of the permit applicant in the subject field of the email.
To whom and on what terms
For a specific reason, the ELY Centre can give the applicant permission to build on a road protection zone if it or the use of the building, construction or equipment do not pose hazards to the traffic safety or cause nuisance to the road maintenance.
A fee is charged for the service.
Check the ELY Centre website for current prices (construction on a road protection zone). Rejected registrations are also subject to a fee.
Work may not be started before a positive decision. More detailed conditions are specified in the permit decision.
Check the average processing time on the ELY Centre website. An incomplete application or missing appendices will slow down the processing of the application.
