The protection zone of a road is the area outside of the road area. In principle, it is prohibited to build buildings, constructions and equipment (a storage, a fence or anything else) on a protection zone or a visibility zone of a road. On application, ELY Centre can for a specific reason grant a special building permit if the construction works or the use of a building, construction or equipment do not pose hazards to the traffic safety or cause nuisance to the road maintenance.
Building on the direct vicinity of a road is restricted mainly for road safety reasons and on the other hand because a road has negative effects on habitability. The purpose of a visibility zone is to safeguard road safety by preserving a good visibility in curves and crossings.
If a privately-owned property lies within a protection zone or a visibility zone of a road, the land owner should be aware of the limitations and obligations concerning building on those areas. All adjoining owners must be consulted in connection with a pending building project. Adjoining owners referred to in the law are the owners of the neighbouring properties and the road keeper when the property has a border along a road, as well as the owners of the opposite property. Also, when there is a plan to repair a building situated on a protection zone or a visibility zone, an opinion must be requested from the ELY Centre before the licensing authority processes the matter regarding a building permit or an action permit.

The application must indicate the planned actions, reasons why the building cannot be situated outside the protection zone, the number of the property (xxx-xxx-xx-xx) and the contact information of the applicant.
Always attach the following appendices to the application: The information presented therein is required for the processing of the application.
- a copy of the consultation statement given by the neighbour of the road keeper (the local ELY Centre)
- indication of the building rights of the property (action decision or other clarification)
- site layout showing the location of the buildings/constructions on the site and their distance from the centre line of the road
- a map indicating the location of the site in relation to the road.

Following the application ELY Centre shall give a decision subject to a fee. The decision shall be subject to appeal before an Administrative Court.
To whom and on what terms
On application, ELY Centre can for a specific reason allow building on a protection zone or a visibility zone of a road if the construction works or the use of a building, construction or equipment do not pose hazards to the traffic safety or cause nuisance to the road maintenance.
A protection zone of a road extends, as a rule,
- on regional roads and connecting roads to 20m
- on highways and main roads to 30m
- on motor ways and motor-traffic ways to 50m
distance from the centre line of a driveway or, if there are multiple driveways, from the centre line of the closest driveway.
The range of the protection zone was extended from 12m to 20m after the coming into force of the Road Act on 1 January 2006.
The visibility zone of a road is the area without visibility restrictions required in curve points, intersections and level crossings of the roads.
A fee is charged for the service.
There is a fee for both a granted permit and a negative decision. The fees are determined annually by a government decree.
A permit for a protection zone or a visibility zone of a road must be obtained before the works are started.
Applications will be processed within 2 to 4 weeks and decisions will be made within 4 to 6 weeks, if possible.
Period of validity
The period of validity shall be bound to the building permit. The period of validity of a deviating decision is mainly 5 years. Nearby urban areas or other places where there is extensive building, the period of validity can be shorter.
