Notice of a debt collector’s action in violation of the law or the good methods of collection

The Regional State Administrative Agency of Southern Finland grants nationally operating licences for debt collection practices and controls that the licensed debt collectors act in compliance with the law and the good methods of collection.

You can notify the Regional State Administrative Agency of shortcomings observed in relation to the debt collection. The Regional State Administrative Agency can give guidance and, if necessary, address the matter. A notice will not necessarily lead into action because the Regional State Administrative Agency’s primary objective is to solve cases concerning serious doubts about action in violation of the law or the good methods of collection. The Regional State Administrative Agency has no authority to express opinions about the action of the principal (the creditor) in debt collection.

If there is a reason to suspect that a debt collector has acted in violation of the law, the Regional State Administrative Agency shall hear the operator and give a written decision on the matter. The Regional State Administrative Agency can give the debt collection agency a warning or, in serious cases, cancel its operating licence due to erroneous action. The Regional State Administrative Agency has no authority to solve any claims governed by private law relating to the case.

The control authority of the Regional State Administrative Agency relates only to measures aimed to persuade the debtor to voluntarily pay the amount due to the creditor (extrajudicial debt recovery). Therefore the Regional State Administrative Agency cannot deal with notices related to judicial debt recovery or execution proceedings.

Summaries have been drafted about the essential questions and policies raised in the control practice and it is a good idea to read the guidelines before notification.

You can transmit the notification electronically or in writing by using a prepared form or in free format. Please send the notification with attachments to the registry of the Regional State Administrative Agency of Southern Finland.

Please enclose the collection letters sent by the debt collector, related email discussions if any and the documents delivered to the debt collector by the notifier.

There is no time limit for the notification but you should send it as soon as possible after the observation of the shortcoming.

The objective is to deal with the cases that do not require a more comprehensive review in a few days. The duration of case handling is 9 months in control matters leading to a written decision. At the moment, the average duration of case handling is 6 months.

To whom and on what terms

Has been a customer of a debt collector or received an authorisation from a debt collector.

The service is free of charge.
