Matters of resident democracy in rented and right of occupancy dwelling

The possibility of residents of rented or right-of-occupancy dwelling to participate in and influence decisions related to the management and care of their residential building, if the owner neglects a task set in legislation concerning the organisation of joint management. Neglected duties include, amongst other things, failure to convene a meeting within the time frame specified in law.
The Regional State Administrative Agency may set a deadline for completing the task or correcting the infringement, or if necessary, impose a default fine to re-enforce the decision.
Only tasks determined in the Act on Joint Management and Right-of-Occupancy Housing Act fall under the jurisdiction of the Regional State Administrative Agency.
The purpose of the Act on Joint Management (Act on Joint Management of Rental Buildings) is to give residents decision-making power and an opportunity to influence matters related to their own housing conditions, to increase comfort and satisfaction and to promote the upkeep and maintenance of rental buildings.
A holder of a right of occupancy and a person dwelling with him or her in a right of occupancy dwelling has the right to participate in the management of the right of occupancy building and decision-making relating to it, and to obtain information on it at least to the extent prescribed in the Act on Joint Management of Rental Buildings.
The Regional State Administrative Agencies for Western and Inland Finland carry out the tasks related to resident democracy nationally.

Submit a free-form application to the Regional State Administrative Agency. Describe as accurately as possible the way in which the owner has neglected a duty set in legislation related to the organisation of joint management. Submit the application to the registry of the Regional State Administrative Agencies for Western and Inland Finland.

A fee is charged for the service.
The fees are determined by the Government Decree on the Regional State Administrative Agencies’ Fees in 2019 and 2020.
