Maternity Investigation

The purpose of establishing maternity is to obtain the information required for confirming the second mother for a child born with the help of fertility treatment. The child welfare officer must establish maternity before the Digital and Population Data Services Agency can confirm that the child also has a second mother.

The person who has given birth to the child is always the child’s mother. A second mother can also be confirmed for the child if the child was born with the help of fertility treatment and both mothers have given their consent to the treatment. The second requirement for confirming maternity is that the child’s father cannot be confirmed or established.

Another woman’s maternity cannot be confirmed before it’s acknowledged. You can acknowledge maternity already before the child’s birth by stating to a nurse at a municipal maternity clinic that you are the child’s second mother. You must do this in person in the presence of the pregnant mother, and you must present a certificate of the fertility treatment received. You can also acknowledge your maternity at the municipal child welfare office. In this case, you must also present the pregnancy certificate provided by the maternity clinic.

If you have acknowledged your maternity before the child’s birth, you will also automatically be considered the child’s guardian as soon as your maternity is established. However, if you acknowledge your maternity after the child has been born, a separate agreement between you and the child’s birth mother has to be drawn up at the child welfare office.

The child welfare officer who established maternity will send the record of the maternity investigation and the acknowledgment documents to the Digital and Population Data Services Agency. If maternity was acknowledged before the child’s birth, the child welfare officer may only prepare the investigation record after 30 days have passed from the child’s birth. The Digital and Population Data Services Agency will confirm maternity on the basis of the documents supplied by the child welfare officer.

Background information

The purpose of investigating maternity is to obtain information based on which it is possible to determine and establish the second mother of a child that is born as a result of assisted fertility treatment. The maternity of a second mother is investigated by a child welfare supervisor and established by the Digital and Population Data Services Agency.

The person who has given birth to a child is always the child’s mother. In addition, the maternity of a second mother can be established if the child was born as a result of an assisted fertility treatment which both mothers consented to. Another prerequisite for establishing maternity is that it is not possible to determine or establish the father of the child.

Before the maternity of the second mother can be established, it has to be acknowledged. You can acknowledge your maternity already during the pregnancy at the prenatal clinic. The pregnant mother has to be present when the acknowledgement takes place. You will also need to bring a certificate of the assisted fertility treatment given to you. You may also do the acknowledgement at the child welfare supervisor’s office. In this case, you will also need to bring a certificate of pregnancy provided to you by your prenatal clinic.

If you have acknowledged your maternity in advance before the child’s birth, you will automatically become the child's guardian once your maternity is established. If you, in turn, acknowledge your maternity only after the child’s birth, a separate agreement on your custody must be made at the child welfare supervisor’s office.

The child welfare supervisor responsible for the investigation of maternity shall deliver the report on the investigation of maternity and the documents regarding the acknowledgement of maternity to the Digital and Population Data Services Agency. If maternity has been acknowledged before the child’s birth, the child welfare supervisor may draft the investigation report no less than 30 days after the birth of the child. The Digital and Population Data Services Agency shall establish maternity on the basis of the documents provided by the child welfare supervisor.
