According to the Working Hours Act, work carried out between 11 pm and 6 am is considered night work. Night work is allowed in work and situations mentioned in the Working Hours Act. In other situations, the employer must apply for a derogation permit for work carried out at night.

Do the following
Apply for the night work permit in writing from the Occupational Safety and Health Division of the Regional State Administrative Agency for Southwest Finland. You can use the form Night work permit application.
Submit a written report on the hearing of employees together with the night work permit application.
Submit the application and its appendices to the Occupational Safety and Health Division of the Regional State Administrative Agency for Southwest Finland. You can find more information about the exemptions granted by the occupational safety and health authorities in the Tyosuojelu.fi web service.
To whom and on what terms
The exemption can be granted for work where the technical quality of the work or other special reasons require it to be carried out as night work. The written permit application should specify the reasons for which the night work permit is applied.
The employer must provide the employee representative (shop steward or elected representative or, in the absence of these, occupational safety and health representative) with an opportunity to be heard on the application for a derogation permit. If there is no such representative at the workplace, the opportunity to be heard must be reserved to all employees that the night work application concerns.
The employer must inform the occupational safety and health authority, at their request, of the night work the employer commissions regularly.
Deadline
Submit the application for a night work permit well before the start of the applied period of validity. The exceptional permit is not granted retroactively.
Processing time
Thirty days since the last report related to the permit has arrived in the Occupational Safety and Health Division of the Regional State Administrative Agency for Southwest Finland.
Period of validity
The period of validity of the permit is specified in the decision concerning it. The night work permit application must specify the period for which the permit is applied.
