Advance notice of construction work

Before the construction work begins, the principal contractor must submit an advance notice of the construction site. The notice is submitted to the Division of Occupational Safety and Health of the Regional State Administrative Agency in whose area the construction site is located. The notice can also be submitted online using a web form.

The notice must be made on a site that is intended to last longer than one month and that, including independent contractors, employs a total of at least 10 employees, and on a site where the amount of work is estimated to exceed 500 person days.

The advance notice must contain the following information:

• contact details of the principal contractor or main contractor

• name of the site and contact details of the person responsible for occupational safety at the site

• name and contact details of the developer or client

• contact details of the developer's responsible safety coordinator

• description of the construction project and form of implementation

• required safety and operation plans and harmful substance surveys

• planned duration of the site

• number and contact details of employers and independent contractors at the construction site.

The notice must include information on the subcontractors and nominated subcontractors, known at the time of the notification, and their estimated labour force data. Employees of all contractors, as well as persons in managerial and supervisory positions, are included in the site’s workforce subject to the reporting obligation.

The principal contractor must also notify the developer of the advance notice.

The notice must be kept up to date where necessary. It is necessary to update the information contained in the notice, especially regarding the names and contact details of the different employers and their responsible persons, working on the site and, correspondingly, of the independent contractors. Up-to-date information facilitates cooperation between various parties on the site.

Although the notice is primarily made for the supervision needs of the Regional State Administrative Agency, it also serves as a source of information for all those working at the site. The advance notice specifies, among other things, the safety responsibilities of the construction project parties. For this reason, also make the notice clearly visible on the site. Keep the notice up to date as necessary. It is necessary to update the information contained in the notice, especially regarding the names and contact details of the different employers and their responsible persons, working on the site and, correspondingly, of the independent contractors.

To whom and on what terms

The construction site's principal contractor (the main contractor or the employer exercising the main authority) has the duty to notify. If the developer has not selected a principal contractor for the shared construction site, the developer must submit the advance notification of the construction site to the Division of Occupational Safety and Health of the Regional State Administrative Agency.

It is not necessary to submit employer-specific start-up notifications, if the principal contractor's notification contains information on all employers, subject to the reporting obligation, on the site. Therefore, each employer and independent entrepreneur who is subject to the reporting obligation, must ensure that their information is included in this notification.

At a shared construction site, the principal contractor (the main contractor or the employer exercising the main authority) submits a joint advance notification of the starting site.

A shared workplace refers to a workplace where employees of several employers or independent contractors work simultaneously or consecutively. The construction site usually has one principal contractor (the main contractor or the employer exercising the main authority) whose obligations are broader than those of other actors on the site.

These obligations include:

  • provide other employers and their employees, as well as independent contractors with information on workplace risks and hazards, safety instructions, and measures related to fire protection, first aid and evacuation, and the persons appointed to them
  • reconcile the activities of employers and self-employed workers in the workplace
  • organise traffic and mobility at the workplace
  • take care of the order and tidiness required for general safety and health at the workplace
  • take care of other general planning at the workplace
  • take care of the general safety of working conditions.

The service is free of charge.


Deadline

The advance notice must be submitted before the construction work begins.

Processing time

Upon receiving the advance notice, the Occupational Safety and Health Division of the Regional State Administrative Agency will assess whether they should perform an inspection or other monitoring measures at the site.

Period of validity

The advance notice must be submitted separately for each fixed-term construction site with a separate start and end date. The notice must be kept up to date where necessary.
