Adjoining owner consultation response

All adjoining owners must be consulted in connection with a pending building project. Adjoining owners referred to in the law are the owners of the neighbouring properties and the road keeper when the property has a border along a road, as well as the owners of the opposite property.

Do the following

Please complete the adjoining owner consultation form available on the websites of most municipalities. The completed consultation form must include copies of the permit application and the following documents:

  • general map showing the location of the site in relation to the road (1:1000, 1:2000)
  • most accurate valid extract from the plan (detailed local plan, detailed shore plan, component master plan, master plan)
  • measurable plot plan including:
  • location of the buildings in relation to the road
  • proposed driveway / access
  • storm-water runoff from the property

Submit the completed consultation form, along with the documents, to the registry of the ELY Centre responsible for the area in which the site is located.

To whom and on what terms

In case of new construction, the municipality must provide clarification on whether the construction requires a planning requirement decision or you can apply directly for a building permit. If you can apply directly for a building permit, the adjoining owner's consultation response is requested from ELY Centre, after which a junction permit or a special building permit for the buffer zone is applied for. If, however, the construction requires a positive planning requirement decision, the adjoining owner's consultation response is requested from the ELY Centre. After a positive planning requirement decision is made, you can apply from the ELY Centre for a junction permit and a deviation decision to build on the roadside buffers or visibility zones.

As a rule, a building may not be located in a roadside buffer zone. Equally, no fence or other structure may not be located in the roadside buffer or visibility zone, if such structure causes problems with regard to traffic safety or road maintenance. On application, ELY Centre can, however, for a specific reason grant a special building permit if the construction works or the use of a building, construction or equipment do not pose hazards to the traffic safety or cause nuisance to the road maintenance.


Deadline

The adjoining owners must be consulted on the pending construction projects before applying for a junction permit or a deviation decision to build on the roadside buffer zone.
